Has specific legislation, final regulations or other formal regulatory guidance addressing the use of AI in your jurisdiction been implemented (vs reliance on existing legislation around IP, cyber, data privacy, etc.)?

No. The Curacao legislator has not yet provided legislation including requirements and/or frameworks for the development and use of AI systems by governments and market participants. Therefore, the general law of obligations and product safety regulations would be applied when AI systems are used and result in issues. In addition, the available intellectual property frameworks, laws and regulations would be applied in the event AI systems are developed and used or when such are infringing existing technologies in Curacao. Although Curacao has the status of associated Overseas Countries and Territories of the Netherlands (non-European countries and territories having special relations with European Union (EU) member state the Netherlands), Curacao is not part of the territory of the European Union and European Community law does not apply there. Therefore, the EU AI Act would not apply to Curacao.
